Terms of Service

By downloading, installing, or using Grain ("the app"), you agree to these Terms of Service. The app is operated by Sonder Digital LLC ("we," "us," "our"). If you do not agree, do not use the app.

1. The Service

Grain is an informational barcode scanner that provides ingredient analysis and ratings for food, drink, supplement, beauty, feminine-care, and household-care products. Some product classes are deliberately not rated (for example alcohol, tobacco, pet food, infant formula, and products sold as pesticides). The app tells you when that is the case. Product information is sourced from public databases (OpenFoodFacts, USDA FDC), AI analysis (Google Gemini), and ingredient status data from the US FDA and the EU (EFSA for food, the SCCS for cosmetics). Grain does not hold status data from other regulators; outside the US and the EU it shows the closest of these two and says so.

Grain is for informational purposes only. The Grain Score and ingredient analysis are not medical advice, nutritional advice, or a substitute for professional guidance. Consult a qualified doctor, dietitian, or healthcare provider for health decisions. We do not diagnose, treat, or prevent any medical condition.

1.2 Accuracy

We strive for accuracy, but product data may be incomplete, outdated, or incorrect. Regulations vary by region and change over time. Always check the product label itself for the most current ingredient list, allergen warnings, and usage instructions.

2. Accounts

A Grain account is required to use the app. You can register with an email address and password or with Sign in with Apple. You must be at least 16 to use Grain, or 13 or older where local law lets you consent to digital services at that age. You are responsible for keeping your password secure and for all activity under your account. Contact us immediately if you suspect unauthorized access. You may delete your account, and the data held under it, at any time from within the app.

3. Subscriptions

Grain offers auto-renewing subscriptions (monthly and annual) for Premium features. All subscriptions are billed through your Apple ID.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions at any time via Settings → [Your Name] → Subscriptions on your iOS device.
  • Unused portion of a free trial is forfeited upon subscribing.
  • No refunds for partial billing periods (unless required by law: EU/UK consumers have 14-day withdrawal rights).

4. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the app.
  • Scrape, republish, or sell the data provided by the app.
  • Use the app to harass, defame, or harm others.
  • Bypass or interfere with security features, rate limits, or the subscription system.
  • Use the app for any unlawful purpose.

To keep the service available for everyone, AI features are limited to 60 requests per account per minute, and each AI feature has a daily fair-use limit on every plan, including Premium.

5. User-Generated Content (Reviews)

If you submit a review or other content to the app, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and use it within the app.

5.1 Zero tolerance for objectionable content

We have a zero-tolerance policy for objectionable content. You must not post:

  • Hate speech, harassment, or content targeting a protected group.
  • Sexual, violent, or otherwise explicit content.
  • Spam, unsolicited advertising, or links to unrelated sites.
  • False, defamatory, or misleading claims about products or companies.
  • Personal information about others (doxxing).
  • Illegal content, including threats or incitement.

5.2 Moderation and enforcement

We reserve the right to:

  • Remove any content that violates these Terms, without notice.
  • Suspend or permanently ban any user who violates these Terms.
  • Act on reports within 24 hours of receipt.

To report abusive content or behavior, use the in-app Report button on any review or email contact@grainios.com. You can also block another user from the menu on any of their reviews, and their reviews will no longer appear to you.

6. Intellectual Property

The app, logo, design, and all content we create are owned by Sonder Digital LLC and protected by copyright and trademark law. Product names, brand names, and certification logos shown in the app belong to their respective owners and are used for informational purposes under fair use / nominative fair use doctrines.

6.1 Open-data attribution

Part of Grain's catalogue comes from Open Food Facts, a collaborative open database, and we pass its licences on to you:

  • Product data (names, ingredient lists, nutrition values) is made available under the Open Database License (ODbL) v1.0.
  • Product photography sourced from Open Food Facts is licensed separately from the data, under Creative Commons Attribution-ShareAlike 3.0 (CC BY-SA 3.0): https://creativecommons.org/licenses/by-sa/3.0/. Those photos were contributed by Open Food Facts contributors and remain under that licence wherever Grain displays them.

Products that Grain imported from USDA FoodData Central may show a product name, brand, and photo from Open Food Facts when both records describe the same product.

How we match (ODbL section 4.6). A USDA product and an Open Food Facts product are matched only when their barcodes are exactly the same after both are normalised the way Open Food Facts normalises barcodes, both barcodes have a valid check digit, and neither is a restricted-circulation number (in-store and variable-weight codes). The two records must then agree on identity: their brands must agree (ignoring case, accents, spacing, punctuation and corporate words such as "Inc" or "Foods", the two brands are the same, one brand's words all appear in the other, or at least half of their words are shared), or, when either record has no brand (or only a placeholder such as "N/A"), their product names must overlap: at least half of the distinctive words used by the two names appear in both, or every distinctive word of the shorter name, at least two of them, appears in the longer one. When both product names have at least two distinctive words and share none, the pair is never matched, whatever the brands say. From a matched Open Food Facts record we copy only its barcode, product name, brands, the addresses of its front photo, the countries it lists, and when the record was last modified, together with the date of the export we read, a note of which rule matched it, and whether Open Food Facts itself imported that record from USDA data. We keep those values in a separate table, keyed by barcode, and nothing copied this way is used to calculate a Grain Score.

Grain's own score, methodology, copy, and design are not covered by either licence.

7. Privacy

Our Privacy Policy describes how we collect and use your information. By using the app, you consent to our data practices as described in the Privacy Policy.

8. Termination

You may stop using the app at any time. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if we are required to by law. Upon termination, any data you haven't downloaded may be deleted.

9. Disclaimers and Limitation of Liability

The app is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the app will be error-free, uninterrupted, or that product data will be accurate or complete.

To the maximum extent permitted by law, Sonder Digital LLC is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the app. Our aggregate liability for any claim related to the app is limited to the greater of $50 USD or the amount you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded by law (e.g. EU consumer rights, statutory warranties).

10. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Sonder Digital LLC is incorporated, without regard to conflict-of-law principles. Consumers in the EU, UK, or other jurisdictions retain the statutory rights of their local law. Any dispute will first be resolved through good-faith negotiation; if unresolved, disputes will be submitted to the competent courts of Sonder Digital LLC's home jurisdiction.

11. Changes to These Terms

We may modify these Terms from time to time. Material changes will be notified in-app and/or via email. Continued use of the app after changes take effect constitutes acceptance.
